1. Acceptance
By accessing or using MailProbe (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
MailProbe is a diagnostic tool that connects to mail servers via SMTP to read greeting banners and report advertised capabilities. It is provided "as is" for informational and diagnostic purposes only.
3. Acceptable Use
You agree to use MailProbe only in accordance with applicable law and these terms. Specifically:
- Authorized targets only. You must only probe mail servers that you own, operate, or have explicit permission to test. Probing servers without authorization may violate computer fraud and abuse laws (e.g. CFAA in the United States, CMA in the United Kingdom, ยง202c StGB in Germany). You are solely responsible for obtaining any necessary authorization.
- No abuse. You may not use MailProbe for reconnaissance, scanning, enumeration, denial-of-service, or any activity that could harm, overload, or disrupt a mail server or network.
- No misuse of results. Probe results are provided for diagnostic purposes. You may not use them to exploit, target, or harass any person or system.
- No circumvention. You may not attempt to bypass rate limits, access restricted features, or interfere with the operation of the Service.
4. No Affiliation
Probing a server does not imply any affiliation, endorsement, or relationship between MailProbe and the operator of that server. The information returned by a server is generated by that server's software, not by MailProbe.
5. Intellectual Property
The MailProbe name, logo, and site design are our intellectual property. The underlying source code is open source. Nothing in these terms grants you a license to use our trademarks or branding.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. PROBE RESULTS MAY BE INACCURATE, INCOMPLETE, OR UNAVAILABLE. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MAILPROBE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Indemnification
You agree to indemnify and hold harmless MailProbe and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these terms, your use of the Service, or your probing of servers without authorization.
9. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted at this URL with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes your acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any disputes arising under these terms shall be resolved in the courts of San Francisco County, California.
